United States v. Coffeyville Resources Refining & Marketing, U.S. District Court, District of Kansas. Mr. Dozier was jointly selected by the parties and appointed by the Court to mediate their settlement negotiations and develop a Consent Decree regarding claims for penalties and injunctive relief filed by the U.S. Coast Guard for alleged violations of Section 301 and 311 of the Clean Water Act (33 U.S.C. §§ 1311, 1312) related to an oil spill of approximately 2145 barrels; for reimbursement of removal costs, interest, administrative costs and attorneys’ fees under Section 1002(a) of the Oil Pollution Act of 1990 (33 U.S.C § 2702(a)) incurred by the United States; and for alleged violations of the Risk Management Program regulations (40 CFR Part 68) and Section 112(r) of Clean Air Act I42 U.S.C. § 7412(r). Based on Mr. Dozier’s mediation, the parties settled all issues.
Barrow Landfill, Barrow, Alaska. Mr. Dozier mediated the development of an allocation procedure and was selected by the parties to allocate costs of the cleanup of a landfill located in the northern-most community in North America. Parties included the U.S. Navy, the U.S. Air Force and the North Slope Borough. Mr. Dozier obtained information regarding waste disposal practices on the North Slope, including conducting interviews with witnesses He then drafted a report summarizing and evaluating the history of waste generation, disposal, and landfill facility operations in Barrow, and recommending an allocation among the parties. Based on Mr. Dozier’s mediation, the parties settled all aspects of the allocation dispute.
Deepwater Horizon Oil Spill Expert Witness, Gulf of Mexico. Mr. Dozier provided expert consulting services to a partial owner of the lease for the Macando well in the Gulf of Mexico. He provided confidential advice and analysis about parties’ liability for the spill and in particular about the allocation of liability among and between potentially responsible parties under the Oil Pollution Act of 1990, the Clean Water Act and other related laws.
Stanrail, Inc. and Roll Form Group (U.S.) Asset Purchase Agreement, Gary, Indiana. Mr. Dozier represented the sellers of a substantial portion of the assets of Stanrail, Inc., an Indiana Corporation engaged in the production of rail road equipment such as box car roofs; steel flooring, uncoupling levers and other heave industrial supplies. Sale issues included valuation, assumption of past and future liabilities, UCC terminations and loan restructuring and releases, representations and warranties and indemnifications from the seller and buyer, and potential environmental land contamination issues.
I-73 Interagency Coordination Team Facilitation, South Carolina. Mr. Dozier facilitated interagency coordination team meetings to draft an Environmental Impact Statement (EIS) and apply for a permit to fill wetlands in order to construct I-73, a new interstate multi-modal transportation corridor in South Carolina. Participants include all South Carolina and federal natural resource, environmental, historic, economic development, emergency management, and transportation agencies.
